These general terms and conditions of contract, along with any specific conditions that may be established, expressly regulate the commercial relationships between CACTUS PRODUCTS, S.L. (hereinafter referred to as CACTUS MEN'S CLUB) and the customer who contracts products and/or services offered through this website.

Customers are informed that CACTUS MEN'S CLUB reserves the right to modify these general terms and conditions of contract, as well as any specific conditions that may be established, respecting the current general conditions at the time of contracting by the customer. In any case, customer acceptance of these conditions, or in their case, along with the specific conditions, will be necessary for the contracting of products and/or services. It should be noted that the validity period of the general conditions and, where appropriate, the specific conditions, coincides with the time they are displayed on this website, and, in any case, respecting the previous conditions accepted by the customer at the time of contracting. The new general conditions, or in their case, specific conditions, will be applicable from the moment they are made available to the customer through this website.

These terms have been drawn up in accordance with the provisions of Law 34/2002, on Information Society Services and Electronic Commerce, Law 7/1998 on General Conditions of Contracting, Royal Legislative Decree 1/2007 approving the consolidated text of the General Law for the Defence of Consumers and Users, as amended by Law 3/2014 of 27 March, Law 7/1996 on Retail Trade Organisation, and any other applicable legal provisions.

By accepting these general conditions, the customer declares to be aware of and to accept the procedures set forth herein as necessary for the contracting of products and/or services, becoming binding.

In the event of a contradiction between the general conditions and the specific conditions, the specific conditions shall prevail. For all other clauses that do not present any incompatibility, the provisions of the general conditions of contract shall apply.

1. Contracting Parties

The electronic contracting process through the website cactusmensclub.com will be carried out between the customer and CACTUS MEN'S CLUB.

Customers who are natural persons, of legal age (over 18 years old), residing in the territory of the European Union, and with a fiscal address in this territory, or legal persons that prove their status and accept these general conditions, and, where appropriate, the specific conditions applicable, will be considered "customers" of this website. The contracting of services and products by minors, users who do not legally reside in the European Union, as well as users who do not comply with the general or specific conditions or when current legislation does not allow it, is expressly prohibited.

2. Pre-contractual Information

All customers will be able to view all the products offered for purchase on the website, classified by categories and subcategories. Access to this website is free, and prior registration is not necessary to view the products and/or services displayed. By clicking on each product, the customer will be able to access a complete product description that will include a brief description, availability, available discounts, price, specifications, and shipping availability. Customers are informed that all data provided in the product descriptions are based on information provided by their suppliers.

All prices are displayed in euros and include the applicable VAT and/or any other applicable taxes. These prices will be valid at all times, except for any manifest typographical errors. Shipping costs are not included in the prices shown for the products and will be broken down later during the contracting process.

3. Phases of the Contracting Procedure

The procedures for purchasing products will be displayed on the screen at all times and described in these General Conditions. Customers may register as members of CACTUS MEN'S CLUB during the purchase of products and/or services. They may also enjoy promotional benefits in case of ongoing promotions. Likewise, the customer is provided with a non-registration method of contracting with CACTUS MEN'S CLUB, where an email address will be requested.

To proceed with the contracting of products and/or services, the customer must validate the shopping cart, which will display all the selected products and/or services, the number of units, the price, the delivery time, and shipping costs. The user can modify the contents of the shopping cart as new products and/or services are selected. The customer can preview the shopping cart with the selected products and/or services pending payment at the top right of the website. If the customer wants to see their order in more detail, they can validate the shopping cart as many times as necessary. From there, they can choose to continue selecting items or confirm their order.

Through the shopping cart screen, the customer can use any discount voucher or gift card provided by CACTUS MEN'S CLUB as a result of a promotion, draw, or other circumstances. To validate it, the customer must enter the coupon code and click "Apply," and the discount will be displayed in the price breakdown, as long as it is still valid according to these general conditions or, where appropriate, the specific conditions.

Once the customer has validated the shopping cart, they must complete the requested information and select, if applicable, the delivery and billing address, shipping method, and choose the payment method they wish to use. They must also accept these general conditions of contract by checking the appropriate box. If this box is not checked, the website will not allow the contracting process to continue.

Payment System

Payment can be made through Bank Cards, Bizum, PayPal, Klarna, Google Pay, and Apple Pay. The customer can choose the payment method after providing the billing information and, if necessary, the shipping information. Payments will be subject to the following conditions:

- Payment by bank card will be made through a payment gateway managed by a banking entity with a secure server certified according to the SSL protocol. The bank details entered are encrypted and securely transmitted to the services of the banking entity, and then verified with the issuing bank to prevent possible fraud and abuse. CACTUS MEN'S CLUB does not have access to the customer's bank details or the bank card used for the contracting.
- All payment methods provided by CACTUS MEN'S CLUB are subject to checks and authorizations by the issuing entities of the payment method. If the payment entities do not authorize the payment, the contracting process cannot proceed, and the order will be canceled, with no product and/or service contracting being considered as completed. It should be noted that the charge for the final price of the contracting, including, where applicable, the shipping costs, as well as any applicable taxes, will be made at the time of formalizing the contract.

Within a maximum period of 24 hours from the moment the customer's payment for the contract is actually made, CACTUS MEN'S CLUB will send an email to the customer containing a summary of the contract. This email will be considered a "contract confirmation."

By accepting this legal text, the customer agrees to receive the invoices derived from the timely contracting in electronic format. If the customer wishes to receive a paper invoice, they must send a request to the email address info@cactusmensclub.com.

If the payment for the contract cannot be effectively made, for any reason attributable to the customer, the order will be automatically canceled.

The confirmation of the contract by the customer implies the acceptance of these general conditions of contract, which will be an integral part of the contract.

4. Right of Withdrawal

In compliance with the applicable legislation, customers have the right to withdraw from the contract within a period of 14 calendar days without the need for justification. The withdrawal period will expire 14 calendar days from the day the customer or a third party indicated by the customer, other than the carrier, acquires physical possession of the goods contracted.

To exercise the right of withdrawal, the customer must notify their decision to withdraw from the contract through an unequivocal statement sent by postal mail to the address CACTUS MEN'S CLUB, CALLE ANGEL GUIMERA, 142, FLOOR 00, DOOR 1, ESPLUGUES DE LLOBREGAT (08950 - BARCELONA), or by email to info@cactusmensclub.com. The customer may use the withdrawal form template provided in Annex 1, although its use is not mandatory.

To comply with the withdrawal period, it is sufficient for the customer to send the communication regarding the exercise of the right of withdrawal before the corresponding period expires.

In case of withdrawal, CACTUS MEN'S CLUB will refund all payments received from the customer, including shipping costs (with the exception of the additional costs resulting from the customer's choice of a different shipping method than the standard shipping method offered), without undue delay and, in any case, no later than 14 calendar days from the date on which CACTUS MEN'S CLUB is informed of the customer's decision to withdraw from the contract. CACTUS MEN'S CLUB will proceed to carry out such reimbursement using the same means of payment used by the customer for the initial transaction unless the customer has expressly provided otherwise; in any case, the customer will not incur any expenses as a result of the reimbursement.

CACTUS MEN'S CLUB may withhold the refund until the goods have been received or until the customer has provided proof of the return of the goods, whichever occurs first.

The customer must return the goods or deliver them to CACTUS MEN'S CLUB, CALLE ANGEL GUIMERA, 142, FLOOR 00, DOOR 1, ESPLUGUES DE LLOBREGAT (08950 - BARCELONA), without undue delay and, in any case, no later than 14 calendar days from the date on which the customer communicates their decision to withdraw from the contract. The deadline will be considered fulfilled if the customer returns the goods before the 14 calendar-day period has expired.

The customer will bear the direct costs of returning the goods, as well as any diminished value of the goods resulting from their handling, other than that necessary to establish the nature, characteristics, and functioning of the goods.

The right of withdrawal will not be applicable to contracts that refer to goods made according to customer specifications or clearly personalized, sealed goods that are not suitable for return due to health or hygiene reasons and that have been unsealed after delivery, or goods that may deteriorate or expire rapidly.
